Terms of Sale & Use
These terms apply when you buy from Loutre et Lys, commission work, or use this website. Please read them before you order. Nothing here affects your statutory rights as a consumer.
1. Who we are
Loutre et Lys is the trading name of Elise Humphries, an independent artist based in Dorset, England.
Our geographic address is given in every quote and on request from [email protected].
Email: [email protected]. We are not registered for VAT, so no VAT is added to our prices.
2. The work
- Originals are one-of-a-kind paintings, panels and illustrations, painted by hand and signed by the artist.
- Murals are painted by hand by the artist, on your wall.
- Prints are reproductions of the artist's original paintings, printed from a high-resolution scan. Limited-edition prints are numbered and signed. Each listing states the edition size and the total number printed across all sizes, and neither will be exceeded. Open-edition prints may be signed. Prints are not hand-painted.
- Brushwork, wood grain, paper texture and small variations are part of hand-painted work, not faults.
- Colours on screen depend on your device. We photograph each piece carefully, but the colour of the actual work may differ slightly from what you see.
- Frames are not included unless the listing says so.
3. Prices and payment
- Prices are in pounds sterling and include standard tracked delivery within the United Kingdom. Any optional extra, such as faster delivery, is shown with its price before you pay.
- Payment is taken by Stripe on its secure checkout. We never see or store your card details.
- Your order is accepted when we email to confirm it. If a piece has sold elsewhere or a price was shown in error, we will tell you promptly and refund you in full.
4. Delivery
Dispatch times and how we pack each piece are set out on our Delivery & Returns page, which forms part of these terms. Unless we agree otherwise, we will deliver within 30 days of accepting your order. A piece is your responsibility from the time it is delivered to you or to someone you nominate.
5. Your right to cancel
- Things you buy online (originals and prints from the shop): you can cancel within 14 days of the day you receive your order, without giving a reason. The process is on the Delivery & Returns page.
- Things made to your specification, such as a commissioned painting, panel or illustration, a personalised print or a size made specially for you, have no 14-day cancellation right, because they are made for you (Consumer Contracts Regulations 2013, reg. 28(1)(b)). You can still end a commission at any time, as set out in section 7.
- Murals are a service. If we agree a mural by email, phone or anywhere other than our studio, you can cancel within 14 days of the day we agree it, without giving a reason (section 7).
6. If something is wrong
- If a piece arrives damaged, faulty or not as described, tell us as soon as you can, ideally within 48 hours, with photographs of the piece and its packaging. That lets us claim from the carrier.
- Within 30 days of delivery you can reject a faulty piece for a full refund. After that, or if you prefer, you can ask us to repair or replace it where that is possible (an original cannot be replaced), and if that fails, to refund or reduce the price, as the Consumer Rights Act 2015 provides. A mural must be painted with reasonable care and skill; if it is not, we will put it right or, if we cannot, reduce the price.
- Your legal rights do not depend on the 48-hour request.
7. Commissions and murals
- We agree the design, size, price, timescale and, for murals, access and preparation in writing before work starts. That written agreement and these terms form the contract.
- Deposit: a 50% deposit secures your place and covers design work. The balance is due before dispatch or, for murals, on completion.
- Revisions: two rounds of changes to the design sketch are included. Later changes, or changes after painting begins, may be charged at an agreed rate.
- Murals: your 14-day right to cancel. Where we agree a mural other than in person at our studio, you may cancel within 14 days of the day we agree it, by email to [email protected] or with the form on our Delivery & Returns page. If you cancel within that period and have not asked us to start work, we refund the deposit in full within 14 days of the day you tell us.
- Starting within the 14 days: we will only start design or painting work within the 14 days if you ask us to in writing (for example when you accept the quote) and confirm that you understand you will lose the right to cancel once the mural is finished. If you then cancel within the 14 days, you pay for the work done up to the time you tell us, in proportion to the full price, and we refund the rest of the deposit within 14 days of the day you tell us. Once the mural is finished, the right to cancel ends.
- Cancelling a commission at other times: you can cancel by email at any time. We keep the part of the deposit that reflects work done and materials bought. If the deposit is more than that, we refund the difference. If the work done is worth more than the deposit, we may invoice the difference.
- Timescales are good-faith estimates. We will keep you informed if anything changes.
- Murals: you own the painted wall or surface. You are responsible for a sound, prepared surface, safe access and any permission you need, such as from a landlord.
8. Copyright and how you may use the artwork
All artwork, designs, illustrations, photographs and text by Loutre et Lys are protected by copyright under the Copyright, Designs and Patents Act 1988 and international law. Copyright belongs to the artist, Elise Humphries.
- Buying a piece gives you the physical work only. It does not transfer copyright or any right to reproduce the image.
- You may display, sell or give away the physical piece you bought. You may photograph it in your home for personal use and share that photograph, crediting Elise Humphries, Loutre et Lys.
- Without our written permission, you may not copy, print, scan, trace or adapt the artwork. You may not use it on products, textiles, wallpaper, packaging, logos, tattoos, NFTs or in any commercial or promotional material. You may not upload it to print-on-demand or stock-image services, or present it as your own.
- Commissions and murals: copyright stays with the artist unless we agree otherwise in writing. We do not reproduce a private commission as a print without your agreement, and we never publish your address. We may photograph the finished work for our portfolio.
- Moral rights: the artist asserts the right to be identified as the creator of all Loutre et Lys work and the right to object to derogatory treatment of it (sections 77 and 80 of the Act).
- Licensing: for licensing, editorial use or reproduction, email [email protected].
9. Website content, data mining and AI
- You may view this website and share links to it.
- The images on this site are provided for viewing only.
- Text and data mining reservation: we expressly reserve all rights to the content of this website against text and data mining, as permitted by Article 4(3) of Directive (EU) 2019/790. This includes collecting images or text to train, fine-tune or prompt artificial-intelligence or machine-learning systems, or to generate work "in the style of" Loutre et Lys.
- No such use is permitted without a written licence.
- This reservation is also published in machine-readable form on this site.
10. Our responsibility to you
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.
- If we paint in your home, we will make good any damage we cause to your property.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
11. Business customers
This section applies only if you buy or commission while acting wholly or mainly for the purposes of your trade, business, craft or profession, for example for a café, shop or office. Section 5 and the 14-day cancellation paragraphs of section 7 do not apply to business customers; the rest of section 7 does. We are not liable for loss of profit, business, goodwill or revenue, or for any indirect or consequential loss. Our total liability to a business customer for any contract is limited to the price paid under it, except where the law does not allow us to limit it. A written quote for a business mural may set out further terms; where it does, the quote takes priority.
12. Privacy
How we handle your details is set out in our Privacy notice.
13. Complaints and law
- If you are unhappy, please email [email protected]. We aim to reply within 7 days.
- These terms are governed by the law of England and Wales.
- If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
